Hi! I'm Samik, and welcome to Silly Pineapple Studio. To save everyone a fair bit of breath, whenever this document says "I," "me," or "my," it refers directly to yours truly and the studio. I manage this website and every little thing on it—from the digital tools to the T-shirts (collectively, the "Services")—so you can enjoy a properly curated shopping trip. My storefront is powered by Shopify, who kindly provide the machinery that makes all this possible.

The terms and conditions below, along with any other policies I've linked here (let's call them the "Terms of Service" or just "Terms").Please give them a careful read, as they cover some pretty important legal territory—like warranty disclaimers and the limits of my liability. I've poured a lot of love and late-night nostalgia into building this little time capsule of a shop, and by exploring the site or picking up one of my pieces, you are agreeing to play by these Terms and my Privacy Policy. If these rules don't quite sit right with you, I completely understand, though I do ask that you only use the services if you're comfortable agreeing to them. I sincerely hope you'll feel right at home here.

SECTION 1 - ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.

To use the Services, including accessing or browsing my online stores or purchasing any of the products or services I offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide in my stores is correct, current and complete and that you have all rights necessary to provide this information.

You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.

SECTION 2 - MY PRODUCTS

I do everything in my power to ensure the online store represents my work accurately. However, just like listening to a classic rock track through two different sets of speakers, the exact colors and details might look slightly different depending on your phone, tablet, or monitor settings.

Here is the director's commentary on how the visuals work: whenever you see a real-world photograph in the shop, it will be clearly marked with a small watermark. The other images are careful simulations meant to show you exactly what to expect. Rest assured, the actual product you're looking at—the shirt and the artwork—is entirely human-made, never AI-generated. I only let AI step in to touch up the surrounding backgrounds, just to make the whole aesthetic pop.

While I try my absolute best to make sure everything looks stellar, I can't legally promise that the final physical item will perfectly match the exact picture in your head or on your screen. Finally, much like a limited vinyl pressing of a great record, I reserve the right to update product descriptions, limit quantities, or discontinue an item entirely without prior notice, at my own discretion.

SECTION 3 - ORDERS

In a world of one-click buying, I prefer to do things the old-fashioned way. When you buy something from Silly Pineapple Studio, we are entering into a bit of a handshake agreement.

Here is the step-by-step journey of your order:

  1. Order Placed: You secure your item.
  2. I personally confirm your order over WhatsApp. This step is absolutely mandatory. If the courier can't reach you, the shirt comes all the way back to me. I am deeply committed to keeping waste and carbon emissions to a minimum, and a simple WhatsApp reply prevents a lot of unnecessary shipping.
  3. The Timeline: I will give you the tentative processing and delivery timeline.
  4. The Connection: I prefer that we get to be humans interacting, rather than just order numbers.

A quick note on ghosting: If I reach out to confirm your details and get no response, I will be putting your order on hold. If the item sells out while we are out of touch, you can choose to get any replacement products or if you wish to have refunds, they will be issued exclusively as store credits. As a solo artist, following this little rule is a great way I can keep giving you a curated experience and make sure that every piece that leaves my studio is worthy of a cornerstone memory for you!

I make sure every product page contains the full briefing: how long an item is available, shipping times, and any current discounts. If you want to have a chat, I love to talk on WhatsApp and Instagram are my absolute preferred ways to talk.

And importantly, when you purchase a product, you agree that your purchases are for your own personal or household use and not for commercial resale or export without explicit written permission from the me, the artist and the creator of the piece.

SECTION 4 - PRICES AND BILLING

Prices, discounts, and promotions might shift from time to time without a formal announcement here, though I always keep the latest updates flowing on my official Instagram and WhatsApp channels. The price for your piece is simply the one in effect the moment you place your order, which will be clearly locked in on your confirmation receipt. Just a polite heads-up: unless I've explicitly mentioned otherwise, the posted prices don't include extra bits like shipping, handling, or taxes.

Every now and then, I love running a special promotion. Those will usually have their own specific guidelines. If there's ever a clash between a promotion's rules and these standard terms, the promotion's rules will always take the lead.

To make sure your transaction goes smoothly, please double-check that your purchase, payment, and account information is current and accurate. If anything changes—like a new email address or an updated card—please update your details promptly so we don't hit any roadblocks getting your order out the door.

Finally, just to keep the legal side of things tidy, placing an order means you are legally confirming a few standard things for me:

  1. The payment and credit card information you've provided is completely true, correct, and complete.
  2. You are officially authorised to use the credit card or payment method you’ve selected.
  3. The charges will actually be honoured by your bank or credit card company.
  4. You agree to pay the total amount due, including the item price, shipping charges, and any applicable taxes.

SECTION 5 - SHIPPING AND DELIVERY

If my three years of experience shipping your favorite products have taught me anything, it's that shipping is probably one of the most weird and wild adventures. 90% of the orders ship out incredibly well, and the details I provide on the respective product pages hold up beautifully. But sometimes, there can be strange issues along the route. I will always do my best to keep you updated when things go off-script because I genuinely feel that these moments need a personal touch more often than not. Despite the occasional chaos, I absolutely love this part of the job, if you ask me.

You should also know that a handful of products ship directly from my manufacturing vendors rather than my own hands (don't worry, I always clearly note this on the product page!). For those items, I rely on your feedback to help me monitor the quality and improve the shop.

Finally, just to cover the formalities: I cannot legally be held responsible for delays caused by shipping carriers, customs, or other wild events outside my control. Because of this, all delivery times are estimates rather than guarantees. To put my lawyer hat on for just a brief second: once a package is transferred to the courier, the title and risk of loss officially pass to you. I can map the route, but the open road is up to the delivery folks!

As a very hard-to-please customer myself, I try to give the best possible experience to you and it perpetually excites me when you like my products. I try to keep shipping absolutely FREE for all of you most of the time, but the final delivery charges and information will be provided to you depending on any custom requests or any other circumstantial issues and it will be confirmed via WhatsApp before the order is processed. (Or you can drop me a message too!)

SECTION 6 - INTELLECTUAL PROPERTY

I’ve poured countless late nights and entirely too many cups of coffee into creating the art, graphics, text, and overall vibe of this site. Almost everything you see here—from the T-shirt designs and product images to the videos and the way the digital shelves are arranged—is an original work crafted by yours truly for Silly Pineapple Studio. Think of this website as my personal sketchbook and studio archive. All the products, images, graphics, text, videos, and even the careful arrangement of the site are my own original creations for Silly Pineapple Studio.

I am absolutely thrilled if you find inspiration in my work, but I do have to lay down one firm ground rule: please don't reproduce, modify, distribute, or republish any of my material without getting my written permission first. Think of it like someone else taking credit for your favorite band's master tapes—it just isn't cool.

Along those same lines, the Silly Pineapple Studio name, my logos, and my slogans are my official trademarks, so please don't use them without asking. As for the Shopify name and logo, those belong to the good folks at Shopify who power this site, and any other brands you might spot around here belong to their rightful owners.

SECTION 7 - OPTIONAL TOOLS

To make your experience here a bit better, I might occasionally offer access to third-party tools or features. Think of them like renting a vintage piece of camera gear for a film shoot—I provide the connection, but I didn't build the equipment, and I have absolutely no control over how it operates behind the scenes.

You acknowledge that I am offering access to these optional tools on an "as is" and "as available" basis. That means no warranties, no guarantees, and no liability on my part if they ever decide to go off-script. Using any of these third-party additions is entirely at your own discretion, so it is always a good idea to brush up on their specific terms and conditions before diving in.

If I introduce any new features, tools, or resources to the studio in the future, they will automatically be governed by these same Terms of Service.

SECTION 8 - THIRD-PARTY LINKS

From time to time, I might include links or materials that take you to websites run by other folks. I don't spend my days examining or verifying the accuracy of the content on those sites, so if you decide to click away and explore those third-party corners of the internet, you are doing so at your own discretion and risk.

Just to keep the legal boundaries clear: I am not liable for any damages or harm related to your use of third-party websites, or any products and services you might buy from them. Please make sure you read and understand their specific policies before you commit to any transactions. If you happen to have a claim, concern, or question regarding a third-party service, you'll need to direct that straight to the third party. My jurisdiction strictly ends at the Silly Pineapple Studio border (Unless specified and mentioned clearly otherwise).

SECTION 9 - RELATIONSHIP WITH SHOPIFY

Silly Pineapple Studio is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in my Store are made directly with Silly Pineapple Studio. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Silly Pineapple Studio, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Silly Pineapple Studio.

SECTION 10 - PRIVACY POLICY

Any personal information I collect while you're hanging out in the shop is strictly governed by my Privacy Policy. And since Shopify is the powerful engine running this whole storefront, certain details are also subject to their Privacy Policy. By using the site, you are simply acknowledging that you've given both of these a read.

Because this studio is hosted on Shopify's platform, they automatically collect and process certain bits of information about your visit just to keep the digital gears turning smoothly. The details you submit might be securely shared with Shopify and a few trusted third-party partners who help me get my art to your front door. Since the internet is a wide-open space, some of those partners might be located in different countries than you are. SECTION 11 - FEEDBACK

If you decide to drop a review, email a suggestion, or share a brilliant idea for the shop (let’s just group it all under "Feedback"), I’m always all ears. By sharing it, you are giving me a perpetual, worldwide, royalty-free license to use, modify, publish, or share those thoughts anywhere—whether that's to improve the storefront or just to feature your kind words in a promo.

Just to keep the legal ledger balanced, please know that I am under no obligation to keep your Feedback a secret, pay you for your ideas, or respond to every single message.

When you leave Feedback, you are also making a handshake promise on a few basic rules:

  • You actually own the rights to what you’re sharing (no stealing someone else's thunder).

  • You aren't using a fake email address or pretending to be someone else.

  • You won't post anything that is illegal, abusive, offensive, defamatory, or loaded with computer viruses. Let's keep the vibes good.

I reserve the right (though not the strict obligation) to edit or remove any comments that cross the line into being offensive or violate someone else's intellectual property. Ultimately, you are solely responsible for whatever you post, and I cannot accept liability for any Feedback left by you or anyone else.

SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS

Just like a rare misprint on a classic album cover, occasionally a typo or an outdated detail might find its way onto the storefront. This could occasionally affect product descriptions, pricing, shipping times, or stock availability. If I catch a mistake, I reserve the right to step in and correct the error, update the details, or cancel an order if it was based on inaccurate information. Please note that I might need to make these fixes at any time without prior notice—even if you've already hit the checkout button. Rest assured, I’m not trying to pull a fast one; I just need the legal clearance to keep the record straight.

SECTION 13 - PROHIBITED USES

I built this studio to feel like a cozy, analog record shop—a peaceful corner of the internet where we can just focus on celebrating good art. To keep the static out and the good vibes rolling, I ask that you only use the site for lawful, well-intentioned purposes.

By hanging out here, you agree not to do any of the following:

  • Break the Law: Don't use the site for anything illegal, sketchy, or malicious that violates local or international laws.

  • Harass or Harm: Please treat people with respect. No abusing, insulting, defaming, or intimidating me or anyone else.

  • Play Pretend: Don't impersonate someone else, transmit false information, or try to run phishing scams.

  • Spread Digital Junk: Keep the space clean. No uploading viruses, malicious code, chain letters, or spam.

  • Send in the Clones: No scraping, data harvesting, or setting loose automated bots, spiders, or AI tools to crawl the site. Let's leave the sci-fi dystopia at the door and keep things strictly human.

  • Pick the Locks: Don't attempt to bypass, interfere with, or circumvent the site's security measures.

If I find that someone is violating these house rules and messing with the peace of the studio, I reserve the right to suspend or terminate their access immediately without any prior notice. Let's just keep things kind and creative so I never have to press that button!

SECTION 14 - AGENTS

Rules of Engagement for Bots & Agents

If you’re deploying an automated bot, AI script, or software drone (what the legal documents call an "Agent") to scout or interact with my site on autopilot, we need to establish some strict Rules of Engagement.

No Agent is allowed to drop into this server unless it clearly broadcasts its ID and follows the tactical protocols below. If I’ve specifically asked a bot to stand down and exit the lobby, it needs to stay out. I also reserve the right to deploy my own countermeasures—like technical limits and firewalls—to control how any Agent interacts with the shop.

If you are sending an Agent into the field, it absolutely must:

  • Broadcast its Tag: It must openly declare itself in all HTTP/HTTPS requests with a clear user string: "Agent/[agent name]". No stealth loadouts.

  • No NPC Disguises: It cannot try to mimic human behavior, bypass CAPTCHAs, or dodge security measures just to pretend it’s a real person.

  • Answer Interrogations Truthfully: If the system prompts it to confirm whether it's a human or a computer, it must confess the truth.

  • Respect the Perimeter: It cannot hack, circumvent, or avoid any technical barricades I put in place to block or manage bot traffic.

SECTION 15 - TERMINATION

If things go completely off-script, I reserve the right to turn off the neon 'Open' sign, end this agreement, or revoke your access to the shop at any time, entirely at my own discretion and without prior notice. Should I ever have to pull the plug, you will still be responsible for settling any outstanding tabs or amounts due up to that final day.

Even after the record stops spinning and we part ways, a few things are built to linger. The heavy-hitting legal clauses—specifically Intellectual Property (keeping the art safe), Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Governing Law, the Privacy Policy, and any other provisions that naturally survive a digital breakup—will remain in full effect long after the closing credits.

SECTION 16 - DISCLAIMER OF WARRANTIES

I put a lot of care into the details I share around the shop, but the information here is meant for general purposes. I can't absolutely promise that every single word is perfectly accurate, complete, or eternally useful, so any reliance you place on it is at your own risk. I have to officially disclaim liability for any mix-ups that happen if you or anyone else relies heavily on these materials.

Now, for the heavy legal disclaimer. Lawyers usually insist on writing this next part in ALL CAPS so it stands out, but since that feels like I'm shouting at you through a megaphone, I am going to use bold text instead to satisfy the legal requirement while keeping the peace:

Except where I explicitly state otherwise, the Services and all the products in this studio are provided strictly on an "as is" and "as available" basis. I am offering them without any representations, warranties, or conditions of any kind, whether express or implied. This includes all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement. While I always strive to give you a great experience, I cannot legally guarantee that your use of the site will be perfectly uninterrupted, timely, secure, or completely error-free. Since some jurisdictions do not allow the exclusion of implied warranties, this specific bolded disclaimer might not apply to your local area.

But mostly, it's chill. So don't worry much about it. We will figure something out for sure.

SECTION 17 - LIMITATION OF LIABILITY

To the fullest extent permitted by law, under no circumstances will I (acting as Silly Pineapple Studio), my partners, contractors, service providers like Shopify, or any affiliates be held liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind. This includes, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages—whether they are based in contract, tort (including negligence), strict liability, or otherwise.

This limitation applies to anything arising from your use of the Services or any products you purchase here, as well as any other claim related in any way to your use of the site or its content. This covers everything from simple errors and omissions in the text to any loss or damage incurred as a result of using the Services or products, even if I have been advised that such damages were a possibility.

SECTION 18 - INDEMNIFICATION

You agree to indemnify, defend and hold harmless Silly Pineapple Studio, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities or claims, including reasonable attorneys' fees, payable to any third party due to or arising out of (1) your breach of these Terms of Service or the documents they incorporate by reference, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services.

I will notify you of any indemnifiable claim, provided that a failure to promptly notify will not relieve you of your obligations unless you are materially prejudiced. I may control the defense and settlement of such claim at your expense, including choice of counsel, but will not settle any claim requiring non-monetary obligations from you without your consent (not to be unreasonably withheld). You will cooperate in the defense of indemnified claims, including by providing relevant documents.

SECTION 19 - SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 20 - WAIVER; ENTIRE AGREEMENT

The failure to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and governs your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

SECTION 21 - ASSIGNMENT

You may not delegate, transfer or assign this Agreement or any of your rights or obligations under these Terms without my prior written consent, and any such attempt will be null and void. I may transfer, assign, or delegate these Terms and my rights and obligations without consent or notice to you.

SECTION 22 - GOVERNING LAW

These Terms of Service and any separate agreements whereby I provide you Services shall be governed by and construed in accordance with the federal and state or territorial courts in the jurisdiction where Silly Pineapple Studio is headquartered. You and Silly Pineapple Studio consent to venue and personal jurisdiction in such courts.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

I reserve the right, in my sole discretion, to update, change, or replace any part of these Terms of Service by posting updates and changes to my website. It is your responsibility to check my website periodically for changes. I will notify you of any material changes to these Terms in accordance with applicable law, and such changes will be effective on the date specified in the notice. Your continued use of or access to the Services following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
